These Terms of Service (“Terms”) govern your access to and use of the websites, applications, products, and services provided by Element Longevity Inc. (“Company,” “we,” “us,” or “our”), doing business as Human Strain, including but not limited to www.humanstrain.com and any related subdomains, mobile apps, or services (collectively, the “Services”).

By using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must discontinue use immediately.

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use our Services. By using the Services, you represent and warrant that you meet these requirements.

Human Strain, manufactured by Element Longevity Inc., provides health and wellness products, microbiome testing services, and related educational resources. Our products and Services are not intended to diagnose, treat, cure, or prevent any disease and should not be considered a substitute for professional medical advice. Always consult with a qualified healthcare provider before making changes to your diet, exercise, or supplement regimen.

You may be required to create an account to access certain Services. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Notify us promptly of any unauthorized use of your account

You are responsible for all activity under your account.

When you purchase products or Services, you agree to provide accurate billing and payment information. All fees are due at the time of purchase unless otherwise specified.

If your purchase includes a subscription:

• Subscriptions automatically renew at the end of each billing cycle unless canceled before renewal.
• You may cancel by logging into your account or contacting hello@humanstrain.com.

We reserve the right to refuse or cancel any order for any reason, including suspected fraud or violation of these Terms.

6. SHIPPING, RETURNS & REFUND POLICY

6.1. Shipping: Shipping times are estimates and not guaranteed. Title and risk of loss pass to you upon our delivery to the carrier.

6.2. 30-Day Return Policy: We want you to be completely satisfied with your purchase. If you change your mind or are unhappy with your product, we accept returns within 30 days of the delivery date.

• Method of Return: All returns must be processed by mail. To initiate a return, please contact us at hello@humanstrain.com for return instructions and our mailing address.
• Item Condition: To be eligible for a return, products must be returned in their original, unopened packaging.
• Return Shipping Costs: For general returns (buyer's remorse), the customer is responsible for the cost of return shipping. We do not charge any additional restocking fees.
• Damaged or Defective Items: If your product arrives damaged or defective, please contact us within 30 days of receipt with photos provided to hello@humanstrain.com. We will replace the defective item or provide a full refund, and we will cover the return shipping costs for defective items.
• Lost Shipments: A shipment is considered lost if not delivered within 14 days of the shipping date (excluding orders marked "delivered" by the carrier).
• Ineligible Purchases: Products forwarded outside our shipping area, international orders, and wholesale orders are not eligible for returns or refunds.

All content, trademarks, service marks, logos (including the Human Strain and Element Longevity logos), and other intellectual property appearing on the Services are owned by or licensed to Element Longevity Inc. You may not copy, reproduce, distribute, or create derivative works from our content without prior written consent.

You agree not to use the Services to:

• Violate any applicable law or regulation
• Engage in fraudulent or deceptive activity
• Interfere with or disrupt the security or performance of the Services
• Attempt to gain unauthorized access to any systems or networks connected to the Services

Our Services may include links to or integrations with third-party services. We are not responsible for the availability, accuracy, or content of these third parties, and your use is subject to their terms.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, ELEMENT LONGEVITY INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) $100.

You agree to defend, indemnify, and hold harmless Element Longevity Inc. and its affiliates, officers, employees, and agents from any claims, damages, liabilities, and expenses arising out of your use of the Services or violation of these Terms.

We may suspend or terminate your access to the Services at any time for any reason, including violation of these Terms. Upon termination, your right to use the Services will immediately cease.

These Terms are governed by and construed in accordance with the laws of the State of Minnesota, without regard to conflict of law principles.

You agree that any dispute, claim, or controversy between you and Element Longevity Inc. arising out of or relating to these Terms or the Services will be resolved exclusively through binding arbitration. Arbitration shall be conducted under the rules of the American Arbitration Association (AAA) before a single arbitrator in Hennepin County, Minnesota. You and Element Longevity Inc. waive the right to a jury trial and to participate in any class action.
